1      Legal Foundation (The Shield): Before any enforcement can occur, the brand must have a robust legal foundation.

◦       U.S. Customs and Border Protection (CBP) Recordation: I record my client's trademarks and copyrights with the CBP. This allows CBP officers to seize infringing goods at the border, stopping them before they ever enter the U.S. market.

2      Online Monitoring and Takedowns (The Watchtower): The vast majority of counterfeiting occurs online, particularly on major e-commerce platforms.

◦       Platform-Specific Programs: I leverage platform-specific brand protection tools (e.g., Amazon Brand Registry, eBay VeRO) to file takedown notices efficiently.

◦       Evidence-Driven Action: Takedown requests must be supported by strong evidence. I coordinate with monitoring services and investigators to gather the necessary proof of infringement, ensuring the takedown is successful and platform policies are followed.

3      Coordinated Enforcement (The Hammer): When online takedowns are insufficient, I escalate to coordinated legal action.

◦       Litigation and Seizure Orders: I pursue federal lawsuits against large-scale counterfeiters, often seeking ex parte (without notice to the defendant) seizure orders to confiscate infringing goods and shut down operations.

◦       Working with Law Enforcement: I coordinate with federal and local law enforcement agencies to pursue criminal and civil actions against major counterfeit rings.
